Conditions: 100 - No supply of alcohol may be made under the Premises Licence - (a). At a time when there is no Designated Premises Supervisor in respect of the Premises Licence; or (b). At a time when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended.

101 - Every supply of alcohol under the Premises Licence must be made, or authorised by, a person who holds a Personal Licence.

125 - That any ‘off sales’ of alcohol shall be provided in sealed containers to be taken away from the premises. Staff shall not open alcoholic drinks containers for customers;

136 - All alcohol shall be ancillary to the operation of the premises as a Restaurant/Takeaway. Alcohol may only be supplied with a food order including deliveries;

138 - All off sales of alcohol for delivery shall be ancillary to the purchase of substantial hot food between the hours of 11:00hrs and 23:00hrs;

163 - That illuminated emergency escape route and emergency exit signage (‘emergency lighting’) shall be installed at the premises, be maintained in full working order, be operational at all times that the premises are in use and shall be maintained free from obstruction at all times;

172 - That appropriate first aid equipment / materials shall be kept at the premises in a dedicated first aid box / boxes. The first aid box(es) shall be kept easily accessible and unobstructed at all times. All staff shall be made aware of where the first aid boxes are located;

180 - That an extract ventilation system shall be installed and maintained in full working order at the premises to prevent the odours / fumes or similar from emanating from the premises and causing nuisance of any kind. The ventilation system shall be serviced and cleaned periodically and a log of such servicing / cleaning shall be kept at the premises and be made immediately available to authorised officers on request;

288 - A digital CCTV system shall be installed at the premises, shall be maintained in full working order and shall be continually recording at all times that the premises are in use. The CCTV system must be capable of capturing a clear facial image of every person who enters the premises. The CCTV system shall be correctly time and date stamped. The CCTV system shall cover all interior and exterior areas of the premises, including the frontage of the premises, and shall collect clearly defined / focused footage in all lighting conditions;

289 - All CCTV footage shall be kept for a period of thirty-one (31) days and shall be made immediately available to Police and authorised officers;

293 - That all relevant staff shall be trained in their responsibilities under the Licensing Act 2003, the promotion of the licensing objectives and the terms and conditions of this licence. Records pertaining to such training (‘the staff training logs’) shall be kept at the premises, shall be updated every 6 months and shall be made immediately available to responsible authority officers on request. The training logs shall include the trainee’s name (in block capitals), the trainer’s name (in block capitals), the date(s) of training and a declaration that the training has been received and understood by the trainee. If the staff training logs are a paper hardcopy then the signature of the trainee, the signature of the trainer shall be included;

304 - A phone number for the premises shall be made available if required upon request to the police, any other responsible authority or any local resident to express any concerns caused by the operation of the premises. Any complaints and the outcome will be recorded in the incident book;

305 - That signage shall be prominently displayed where it can easily be seen and read by passers-by stating to the effect that the premises are closed to members of the public between the hours of 02:00hrs and 05:00hrs;

311 - Signage instructing all staff/delivery drivers/riders to respect local residents, keep noise levels down and switch engines off whilst waiting;

316 - No deliveries will be received or rubbish removed from the premises between 22:00hrs and 07:00hrs;

336 - The DPS, a Personal Licence holder or trained member of staff nominated in writing by the DPS shall be on duty at all times the premises are open to the public;

340 - The sale of alcohol for consumption off the premises shall be by delivery only and will be restricted to online delivery orders to registered residential or business addresses only;

341 - There shall be no off sales of alcohol after 23:00hrs;

342 - The venue shall be closed to all members of public from 02:00hrs to 05:00hrs Thursday, Friday and Saturday; the exception this being registered delivery drivers;

343 - A member of staff who is trained in the use of the CCTV system and who is able to view, and download to a removable storage device, CCTV footage at the immediate request of Police and authorised officers shall be on duty at all times that the premises are in use;

344 - That clearly legible signage shall be prominently displayed where it can easily be seen and read by customers advising to the effect that CCTV is in operation at the premises. The signage shall be kept free from obstructions at all times;

345 - That an incident log shall be kept at the premises to record details of any of the following occurrences at the premises: a) Instances of anti-social or disorderly behaviour b) Calls to the police or other emergency services c) Any complaints received d) Ejections of people from the premises e) Visits to the premises by the local authority or emergency services f) Any malfunction in respect of the CCTV system g) All crimes reported by customers, or observed by staff h) Any other relevant incidents The incident log shall record the time, date, location in the premises and description of each incident, details of any action taken in respect of the incident and the printed name of the person reporting the incident and. The incident log shall be available / be accessible at the premises at all times that the premises are in use, and shall be made immediately available to responsible authority officers on request. Details of incidents shall be recorded contemporaneously. If the incident log is a paper hardcopy then the signature of the person reporting the incident in the log shall also be included. All relevant staff employed at the premises shall be trained in the use of the incident log. Details of such training, including the printed name(s) of the trainee(s) and the date(s) that the training was given, shall be recorded in the staff training logs at the premises. That all Digital records of training and/or logs shall be made immediately available to Police and authorised officers;

346 - That only experienced and reputable delivery companies will be able to make deliveries on behalf of the venue. That details of the delivery companies used shall be recorded in written or digital format and made available to police or authorised officers;

347 - That staff shall monitor the delivery driver/riders waiting area and ensure that the operatives do not cause any nuisance be that noise or otherwise to their neighbours;

348 - That all online sales of alcohol are subject to a real time age verification check before alcohol is dispatched for delivery;

349 - That drivers (whether employed directly, as self-employed or via third parties) shall undertake training regarding age verification to ensure that the required checks are conducted at the point of delivery when a customer appears to be under 25 years old;

350 - ID verification will be made when orders containing alcohol are delivered (no ID no delivery) – acceptable proof of age shall include identification bearing the customer’s photograph, date of birth and integral holographic mark or security measure;

351 - The name used to make the purchase must match the name on the ID (this will be explained at checkout);

352 - That all refusals of orders at either the order or delivery stage are recorded in a refusals book;

354 - That all emergency exits, emergency escape routes and entry / exit doors at the premises shall be kept free from obstructions at all times that the premises are in use;

355 - That an accident book / recording system shall be maintained at the premises and be available and in use at all times that the premises are in operation. The accident book / recording system shall meet all current legislative requirements. Details of any accidents will be recorded in the accident book / recording system contemporaneously. The accident book / recording system shall be made immediately available to responsible authority officers on request. Relevant staff shall be trained in this, and details of such training including the printed name(s) of the trainee(s), and the date(s) that the training was given, shall be recorded in the staff training logs at the premises;

356 - That any delivery drivers and / or delivery companies that the licensee uses will be instructed as follows: a) all vehicle engines are turned off when deliveries are being collected from the premises b) that all delivery drivers behave in a quiet and orderly manner with respect to local residents c) that delivery drivers do not use vehicle horns to attract the attention of workers at the premises, or otherwise use their vehicle horns unnecessarily when approaching or leaving the premises and d) that delivery drivers do not engage in unnecessary revving of engines on approaching or leaving the premises and locale. The above must be specified in any contract / written instructions to delivery drivers and / or delivery companies, and evidence of this shall be made available to authorised officers immediately on request

357 - That staff shall be trained to arrive at, conduct themselves at the premises at all times, operate the premises and leave the premises in an orderly manner, with particular care taken when staff close the premises at the end of trade on each day. The details of such training, including the printed name(s) of the trainee(s) and the date(s) that the training was given, shall be recorded in the staff training logs at the premises;

358 - That any kitchen extract and / or ventilation systems (user accessible parts) will be cleaned periodically (at least monthly) by staff and / or a person qualified to do so. Details of such cleaning shall be kept in a log that shall be made immediately available to authorised officers on request;

359 - That any kitchen extract and / or ventilation systems be inspected at least once annually by a person qualified to do so to ensure that they are in full working order. The details of any such inspections shall be kept at the premises and be made immediately available for inspection on the request of authorised officers. Any maintenance works to the kitchen extract and / or ventilation identified as required, subsequent to such inspections, shall be undertaken as soon as practicably possible;

360 - That staff shall be instructed not to play loud music / entertainment at the premises. The details of such instruction shall be recorded in the staff training logs at the premises;

361 - Notices will be prominently displayed by the entry/ exit door and point of sale (as appropriate) advising customers: a) That CCTV & Challenge 25 are in operation b) Advising customers of the provisions of the licensing act regarding underage & proxy sales c) Of the permitted hours for licensable activities & the opening times of the premises d) Do respect residents, leave quietly, not to loiter outside the premises or in the vicinity and to dispose of litter legally

362 - The front of the premises shall be kept tidy at all times and be swept at close;

363 - That, to discourage ‘street drinking’ in the locale by customers of the premises, clearly legible signage shall be prominently displayed where it can easily be seen and read by customers at all exits to police & authorized council officers on request. Training will include identifying persons Under 25, making a challenge, acceptable signage shall be kept free from obstructions at all times; conflict & responsible alcohol retailing;

364 - All alcohol will be displayed and kept and will be sold from behind the counter and to be dispensed by a member of staff only;

365 - The delivery of alcohol to be made only to a residential or business address, where it is clearly evident that the customer is a resident or occupies the business;

366 - The delivery of alcohol will not be made to a person in a public place such as a street corner, park or bus stop etc.;

367 - No more than 4 customers at one time present in the premises between the hours of 01:00 to 02:00 Thursday, Friday and Saturday.

368 - The premisses operate as take away only and no eating in at the premisses between 01:00 to 02:00 on Thursday, Friday and Saturday.

488 - (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either (a) a holographic mark; or (b) an ultraviolet feature.

491 - 1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2. For the purpose of the condition set out in paragraph (1): (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b) "permitted price" is the price found by applying the formula P = D + (D x V), where- (i) P is the permitted price, (ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence – (i) the holder of the premises licence: (ii) the designated premises supervisor (if any) in respect of such a licence; or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (iv) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (v)"value added tax" means value added tax charged in accordance with the Value Added Tax Act 1994. 3. Where the permitted price given by paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4. (1) Sub-paragraph (2) applies where the permitted price given by paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax; (2) the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

4AA - Challenge 25 shall be operated as the proof of age policy and only a valid passport, photo driving license, hm forces photographic id card or proof of age card with the pass logo or hologram on it may be accepted as proof of age. Relevant notices will be prominently displayed by the entry/ exit door and point of sale as appropriate;

4AI - All refusals of the sale of alcohol shall be recorded in the refusals section of the incident book. The incident book shall be kept and produced to police & authorized council officers on request

4AL - A fire risk assessment and emergency plan will be prepared and regularly reviewed. All staff will receive appropriate fire safety training and refresher training;
