Conditions: 100 - No supply of alcohol may be made under the Premises Licence - (a). At a time when there is no Designated Premises Supervisor in respect of the Premises Licence; or (b). At a time when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended.

101 - Every supply of alcohol under the Premises Licence must be made, or authorised by, a person who holds a Personal Licence.

340 - Appropriate induction training shall be undertaken with all relevant staff who do not hold a Personal Licence to cover appropriate subjects for their role including: a. The responsible sale of alcohol. b. The prevention of under-age sales of alcohol, the Challenge 25 policy and in checking & authenticating accepted forms of identification. c. The responsibility to refuse the sale of alcohol to any person who is drunk. d. Fire safety & emergency evacuation procedures All training shall be recorded and training records made available on request to an authorised officer of the Licensing Authority or the Police.

341 - The premises shall maintain written reports and registers. These shall be kept for a minimum of 12 months and made available to the police and any authorised officer of the licensing authority on request. Records shall be maintained of the following: a. Any complaint against the premises in respect of any of the licensing objectives b. Any crime reported at the premises c. Any fault in the CCTV system All written reports and registers shall be regularly checked by the DPS.

342 - Alcohol shall only be sold for consumption off the premises when such a sale is ancillary to the sale of food for delivery or collection or to customers who have consumed a table meal at the premises.

343 - The venue shall maintain a CCTV system. The CCTV system shall continually record whilst the venue is open for licensable activities and / or when customers remain on the premises. All recordings shall be time & date stamped, maintained for a 31-day period and be made available to the Police or authorised officer of the licensing authority upon request. The CCTV system shall: a. Cover all entry points used by the public. b. Enable frontal identification of persons entering in any light condition. c. Be maintained by a suitably qualified person.

344 - Sufficient competent persons should be authorised by the premises licence holder to provide the Police with downloaded CCTV data (footage and / or images) in an appropriate recorded format (usually to a disc, memory stick or data file sent electronically) when formally requested to do so. The authorised person(s) should be sufficient to enable such data to be obtained by the police within 48 hours of a formal request being made.

345 - A zero-tolerance policy towards the use, possession and supply of illegal drugs shall be adopted and enforced.

346 - Alcohol shall not be sold or supplied to patrons otherwise than those who are seated at the premises & taking a table meal there and for consumption by such persons as ancillary to the table meal with the following exceptions: a. A maximum of 20 patrons may be served alcohol at any time while they are not seated, nor taking a table meal at the premises when attending an event in Arch Two to the rear of the premises (as marked on the plans) b. A maximum of 15 patrons may be served alcohol when they are not seated at the premises, while waiting for a table to become available shall be permitted to consume alcohol. They shall be shown to their table with the minimum of delay once a suitable table becomes available.

347 - A fire risk assessment shall be conducted and regularly reviewed. In-line with the Fire Risk Assessment: a. Heat / Smoke detectors are installed and maintained by a competent person. b. An integrated fire detection and alarm system is installed, checked, regularly tested and maintained by a competent person. c. Fire extinguishers are installed in accordance with the recommendations of the fire risk assessment. d. Emergency lighting is installed in accordance with the recommendations of the fire risk assessment. e. All emergency exits are marked on the premises plan.

348 - No commercial waste shall be left on the street, all waste shall be stored in the commercial bins provided, prior to collection.

349 - Commercial waste shall only be collected from the service road to the rear of the premises. No waste shall be placed out or collected from the entrance on Blenheim Grove.

350 - Between 17:00 and 09:00, deliveries related to the permissible Licensable Activities shall only be made via the service road to the rear of the premises and not via the front entrance on Blenheim Grove.

351 - Deliveries from the premises shall only be serviced from the rear of the premises and no delivery drivers shall be permitted to collect a take-away delivery from the front of the premises on Blenheim Grove.

352 - The area immediately outside the premises shall be maintained to ensure that any litter generated by the premises and / or its customers is regularly cleared.

353 - No noise generated on the premises, or by its associated plant or equipment, shall emanate from the premises nor vibration be transmitted through the structure of the premises which gives rise to a nuisance.

354 - No amplification system or speakers shall be used in the external areas to the front of the premises on Blenheim Grove.

355 - An area shall be set aside for smoking to the rear of the premises, no smoking shall be permitted to the front of the premises on Blenheim Grove, signage to this effect shall be displayed in the front courtyard.

356 - Alcoholic drinks sold for consumption on the premises, shall not be permitted to leave the licensed area of the premises (as delineated within the red lines on the associated plans) at any time, including for those leaving for the purpose of smoking.

357 - A sign requesting customers to respect local residents and leave the premises quietly, shall be displayed at each public the exit to the premises.

358 - A suitable dispersal policy shall be adopted by the premises and all relevant staff shall receive training in the implementation of the policy. A copy of the policy shall be kept at the premises and made available to the police or environmental health officer on request.

359 - Any customers and staff leaving after 21:00 shall be directed to leave via the service road to the rear of the premises.

360 - The external doors to the front of the premises on Blenheim Grove shall remain closed after 21:00 except for entrance and egress.

361 - A Challenge 25 policy shall be enforced, where any person reasonably looking under the age of 25 shall be asked to prove their age when attempting to purchase alcohol; signs to this effect shall be displayed at the premises. The only acceptable forms of identity shall be those photographic identification documents recognised in the Home Office guidance; including passports, photo-card driving licence or proof of age card bearing a PASS hologram.

362 - A register of refusals book or electronic equivalent designed to record all refusals of sales of alcohol shall be maintained on the premises and made available to the police and local authority officers upon reasonable request.

363 - An age gate shall be included on the website used for the purpose of generating sales of alcohol by the Premises Licence holder.

364 - Delivery instructions to drivers shall include instructions not to deliver to any person under the age of 18 and to challenge any person looking under 25 to produce valid ID to prove they are over 18 years of age.

485 - (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises – (a) games or other activities which require or encourage, or are designed to require, encourage, individuals to - (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (whether within a time limit or otherwise); (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective; (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner carries a significant risk of undermining a licensing objective; (d) selling or supplying alcohol in association with promotional poster or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner; and (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

487 - The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

488 - (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either (a) a holographic mark; or (b) an ultraviolet feature.

489 - The responsible person shall ensure that - (a) Where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures - (i) Beer or cider: 1/2 pint; (ii) Gin, rum, vodka or whisky: 25 ml or 35 ml; and (iii) Still wine in a glass: 125 ml; (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available,

491 - 1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2. For the purpose of the condition set out in paragraph (1): (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b) "permitted price" is the price found by applying the formula P = D + (D x V), where- (i) P is the permitted price, (ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence – (i) the holder of the premises licence: (ii) the designated premises supervisor (if any) in respect of such a licence; or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (iv) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (v)"value added tax" means value added tax charged in accordance with the Value Added Tax Act 1994. 3. Where the permitted price given by paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4. (1) Sub-paragraph (2) applies where the permitted price given by paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax; (2) the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

840 - External waste handling and bottling shall only occur between the hours of 08:00 and 20:00.

841 - A dedicated contact telephone number for the premises shall be prominently displayed where it can easily be seen and read by passers-by. If the telephone number relates to a mobile phone, then the duty manager / supervisor on duty shall have the mobile phone on their person at all times.

842 - That delivery drivers will be instructed to turn their engines off when collecting orders for delivery from the premises.

843 - That clearly legible signage shall be prominently displayed both inside and outside the premises where it can easily be seen and read by delivery drivers advising to the effect that: a) That all vehicle engines must be turned off b) That all delivery drivers shall behave in a quiet and orderly manner with respect to local residents and businesses c) That delivery drivers shall not use vehicle horns to attract the attention of workers at the premises or otherwise use their vehicle horns unnecessarily when approaching or leaving the premises and d) That delivery drivers shall not engage in unnecessary revving of engines on approaching or leaving the premises and locale.

844 - That the maximum number of people permitted on the premises at any one time (the ‘accommodation limit’) is 165 people (excluding staff). The accommodation limit shall be known by all staff and shall not be exceeded at any time.
