Conditions: 100 - No supply of alcohol may be made under the Premises Licence - (a). At a time when there is no Designated Premises Supervisor in respect of the Premises Licence; or (b). At a time when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended.

101 - Every supply of alcohol under the Premises Licence must be made, or authorised by, a person who holds a Personal Licence.

102 - The admission of children to films given under this licence must be restricted in accordance with the recommendations of the British Board of Film Classification or of the licensing authority itself.

340 - That a CCTV system shall be installed at the premises, be maintained in good working order and be continually recording at all times the premises are in use.

341 - That all CCTV footage shall be kept for a period of 31 days and shall be made immediately available to officers of the police and / or council on request.

342 - That a member of staff shall be on duty at all times that the premises are open who is trained in the use of the CCTV system and who is able to view, and download to a removable device, CCTV footage at the request of police and / or council officers.

343 - That all staff shall be trained in their responsibilities under the Licensing Act 2003 and the terms and conditions of this licence. Records pertaining to such training shall be kept and signed, be updated every 6 months and shall be made immediately available to council and / or police officers on request.

344 - That when regulated entertainment in the form of live or recorded music is being provided at the premises a minimum of two (2) SIA registered door supervisors shall be employed at the premises. They will be employed at all times that the entertainment is provided until the end of business and all patrons have vacated the premises. They will be engaged to monitor admissions and re-admissions to the premises, provide security for staff and customers, screen entrants to the premises, deal with conflict arising at the premises and to ensure that the dispersal policy regarding the premises is implemented.

345 - That the overall accommodation limit of the premises at any one time is 250 persons (not including staff), including specific accommodation limits (not including staff) for the following three areas as identified on the plan attached to this licence: (1) Bar Area - 36 persons (2) Event Space - 40 persons (3) External Seating Area - 10 persons The overall accommodation limit shall not be exceeded at any time.

346 - That all ‘off sales’ of alcohol shall be provided in sealed containers.

347 - That clearly legible signage shall be prominently displayed where it can be easily seen and read requesting to the effect that ‘off sales’ of alcohol are not opened and consumed in the vicinity of the premises.

348 - That a dispersal policy shall be devised and be maintained in operation at all times that the premises are in use. A copy of the dispersal policy shall be made immediately available / accessible to the police and / or council officers on request.

349 - That clearly legible signage shall be prominently displayed at all entrances to the premises, where it can be easily seen and read from the exterior of the premises, stating the opening times of the premises.

350 - That clearly legible signage shall be prominently displayed throughout the premises, where it can be easily seen and read, advising to the effect that customers be vigilant regarding potential criminal activity (e.g. theft).

351 - That custom will not be sought by means of personal solicitation outside or in the vicinity of the premises.

352 - That management, supervisory and all staff involved in the provision of any licensable activities or regulated entertainment at the premises shall be trained in the detection and prevention of illegal drug use at the premises and the action to be taken should illegal drug use be detected at the premises. Records of such training shall be made immediately available / accessible to the police and / or council officers on request.

353 - That sufficient management light shall be installed at the premises, and maintained in full working order at all times that the premises are in operation, such that customers can safely navigate the premises at all times and exit the premises safely in an emergency.

354 - That all staff involved in the sale of alcohol shall be trained in the prevention of sales of alcohol to underage persons. A record of such training shall be kept / be accessible at the premises and be made immediately available for inspection to council and / or police officers on request.

355 - That clearly legible signage shall be prominently displayed throughout the premises, where it can be easily seen and read, advising customers to the effect that if customers look under 25 years old then they may be asked to provide valid photographic identification proving that they are over 18 years old. Valid photographic identification shall be stated as a driving licence, passport, UK armed services ID card, any Proof of Age Standards Scheme (PASS) accredited card or any identification card validated by the Secretary of State.

356 - That an incident log book / incident recording system shall be kept at the premises to record details of any of the following occurrences at the premises: • Instances of anti-social or disorderly behaviour • Seizure of drugs or weapons • Calls to the police or fire brigade • Any complaints received • Ejections of people from the premises • Visits to the premises by the local authority, police or fire brigade • Refused sales of alcohol • Any malfunction in respect of the CCTV system, searching equipment or scanning equipment • All crimes reported • Any other relevant incidents The incident book / incident recording system shall record the time, date, location and description of each incident, the printed and signed name of the person reporting the incident and any action taken in respect of the incident. The incident book / incident recording system shall be available / be accessible at the premises at all times that the premises are in use and shall be made available to officers of the council, police or fire brigade on request.

357 - That all parts of the premises and all fittings and apparatus therein, door fastenings and notices, lighting, heating, electrical, air conditioning, sanitary accommodation and other installations shall be maintained at all times in good order and in a safe condition.

358 - That clearly legible signage shall be prominently displayed at all exits from the premises and in any external area of the premises where it can be easily seen and read requesting to the effect that customers should leave the premises and locale in a quiet and orderly manner with respect to local residents.

359 - That the licensee shall instruct that all staff who arrive in the early morning or who depart late at night leave the premises and locale in a quiet and orderly manner with respect to local residents. A record of such instruction shall be kept / be accessible at the premises and be provided to council and / or police officers immediately on request.

360 - That if and when required, security, stewarding or other designated staff shall request that customers behave in a quiet and orderly manner at the premises and / or in the immediate vicinity of the premises.

361 - That customers shall not be permitted on the premises outside of the opening hours stated in this licence.

362 - That any lighting installed at the premises shall be positioned and / or screened in such a manner so that it does not cause nuisance.

363 - That the external area(s) of the premises and the immediate vicinity of the premises shall be periodically and regularly cleared of any waste arising through the operation of the premises whilst the premises are in operation. At the end of trade on each day the external area(s) of the premises and immediate vicinity of the premises shall be cleared of any waste caused by the operation of the premises.

364 - That an adequate number of suitable waste receptacles for use by customers shall be located in both the internal and external areas of the premises.

485 - (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises – (a) games or other activities which require or encourage, or are designed to require, encourage, individuals to - (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (whether within a time limit or otherwise); (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective; (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner carries a significant risk of undermining a licensing objective; (d) selling or supplying alcohol in association with promotional poster or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner; and (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

487 - The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

488 - (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either (a) a holographic mark; or (b) an ultraviolet feature.

489 - The responsible person shall ensure that - (a) Where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures - (i) Beer or cider: 1/2 pint; (ii) Gin, rum, vodka or whisky: 25 ml or 35 ml; and (iii) Still wine in a glass: 125 ml; (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available,

491 - 1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2. For the purpose of the condition set out in paragraph (1): (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b) "permitted price" is the price found by applying the formula P = D + (D x V), where- (i) P is the permitted price, (ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence – (i) the holder of the premises licence: (ii) the designated premises supervisor (if any) in respect of such a licence; or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (iv) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (v)"value added tax" means value added tax charged in accordance with the Value Added Tax Act 1994. 3. Where the permitted price given by paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4. (1) Sub-paragraph (2) applies where the permitted price given by paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax; (2) the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

840 - That a direct telephone number for the manager at the premises shall be publicly available at all times the premises is open. The telephone number is to be made available to residents in the vicinity.

841 - That off sales are only permitted to be sold from the event room when events take place.

842 - That at least one SIA licensed door supervisor shall be on duty at the premises at all times whilst it is open for business after 21:00.

843 - That when events are taking place the premises will carry out a risk assessment to determine the number of SIA licensed door supervisors required to be on duty whilst the events are taking place.

844 - That there shall be no admittance or re-admittance to the premises after 21:00 with the exception of patrons being permitted to temporarily leave and then re-enter the premises for the purposes of smoking, limited to 10 persons at any one time.

845 - That only the main entrance on Bournemouth Close will be used for ingress / egress to the premises after 21:00.

846 - That smoking shall only permitted in the external seating area to a maximum of 10 patrons. After 21:00, smokers will be directed to smoke on Rye Lane.

847 - That the external area will be rendered unusable after 21:00.

848 - That no rubbish, including bottles, shall be disposed of in outside receptacles or outside areas between 20:00 and 08:00 the following day.
