Conditions: 100 - No supply of alcohol may be made under the Premises Licence - (a). At a time when there is no Designated Premises Supervisor in respect of the Premises Licence; or (b). At a time when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended.

101 - Every supply of alcohol under the Premises Licence must be made, or authorised by, a person who holds a Personal Licence.

340 - That any beers, lagers, ciders or similar alcoholic beverages sold at the premises with an alcohol by volume (ABV) in excess of 6.5% shall not be packaged in containers with a capacity larger than 750ml.

341 - That the accommodation limit of the premises is 150 persons.

342 - That a written dispersal policy shall be devised regarding the premises and maintained in use at all times that the premises are in operation. A copy of the dispersal policy shall be kept at the premises with the licence and be made available for inspection to council and / or police officers. All relevant staff shall be trained regarding the implementation of the policy.

343 - That any ‘off sales’ of alcohol shall be provided in sealed containers to be taken away from the premises.

344 - That clearly legible signage shall be prominently displayed where it can easily be seen and read by customers, requesting that alcohol sold as ‘off sales’ should not be opened and consumed in the vicinity of the premises.

345 - That clearly legible signage shall be displayed on the railings / fence by the entrance to 108 – 110 Bellenden Road, where it can easily be seen and read by passers by on Bellenden Road, stating a contact number for the premises. A message stating to the effect that local residents can contact the number during operational hours should they have any concerns or complaints shall also be displayed on the notice. The contact number provided on the notice shall be operational at all times that the premises are in use. Such signage shall be kept free from obstructions.

346 - That clearly legible signage shall be displayed at all exits from the premises and the premises’ external area, where it can easily be seen and read by customers, requesting to the effect that customers leave the premises and locale in a quiet and orderly manner with respect to local residents. Such signage shall be kept free from obstructions.

347 - That the external area of the premises shall be shut to customers by 21:30 hours save for up to five customers at any one time who shall be permitted to smoke only. Any tables or chairs in the external area shall be removed / rendered unusable by 21:30 hours and if / when required, customers shall be instructed by staff that they are not permitted to use the external area after this time. Clearly legible signage shall be displayed at all exits from the premises, where it can easily be seen and read by customers, stating to the effect that customers are not permitted in the external area after 21:30 hours. Customers shall not be permitted to take drinks outside with them after 21:30 hours.

348 - That the doors to the premises shall be closed at 21:30 on each day except to allow immediate, and / or emergency, access and egress to and from the premises. Any windows at the premises shall be closed at 21:30 on each day.

349 - That during the 15 minutes prior to closing time on each day a member of staff shall be on duty in the premises’ external area to aid in the quiet and orderly dispersal of customers from the premises and locale. If and when required, the staff member shall request to the effect that customers behave in a quiet and orderly manner with respect to local residents. If and when required, the staff member shall give directions regarding the quickest routes to the nearest public transport points.

350 - That staff shall be trained as to where the nearest public transport points are and the quickest routes to get to them. A record of such training, including the name of the trainee, the trainee’s printed name, the trainee’s signature and a declaration that the training has been received and understood shall be kept at the premises and be made available to officers of the police and / or council on request.

351 - That all lighting in the public areas of the premises (‘house lights’) shall be turned up to their full settings (i.e. non-dimmed) 30 minutes prior to closing time, and until the premises closes on each day, to encourage customers to leave.

352 - That staff shall regularly monitor the external area of the premises and, if / when required, shall request that customers behave in a quiet and orderly manner with respect to local residents. Staff shall instruct any persistently noisy or disorderly customers that they may be refused further service if they continue to behave in a noisy or disorderly manner.

353 - That security shutters shall be installed at so that the premises may be fully secured at all times that it is not in operation.

354 - That a CCTV system shall be installed at the premises, be maintained in good working order and be continually recording at all times that the premises are in use under this licence. The CCTV system must be capable of capturing all public areas of the premises and all entrances / exits at the premises.

355 - That clearly legible signage shall be displayed at the entrance to the premises, where it can easily be seen and read by customers, stating the operating hours of the premises.

356 - That clearly legible crime prevention signage shall be displayed in the premises where it can easily be seen and read by customers.

357 - That custom shall not be sought by means of personal solicitation outside or in the vicinity of the premises.

358 - That staff shall be trained in the detection and prevention of illegal drug use at the premises.

359 - That management lighting shall be maintained at the premises at all times that the premises are in operation such that staff and customers and easily and safely navigate / traverse the premises.

360 - That a log book or recording system shall be kept at the premises in which the particulars of inspections made shall be entered, including those inspections required to be made by statute, and information compiled to comply with any public safety condition attached to the premises licence that requires the recording of such information. The log book shall be kept available for inspection.

361 - That all parts of the premises and all fittings and apparatus therein, door fastenings and notices, lighting, heating, electrical, air condition, sanitary accommodation and other installations, will be maintained at all times in good order and in a safe condition.

362 - That deliveries of goods necessary for the operation of the business will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents.

363 - That the licensee / premises management shall ensure that staff who arrive in the early morning, or depart late at night, conduct themselves in such a manner so as to avoid causing disturbance / nuisance to nearby residents.

364 - That any lighting on or outside the premises will be positioned and / or screened in such a way so that it does not cause a nuisance to nearby residents.

365 - That an adequate amount of suitable waste receptacles for use by customers will be provided in both the internal and external areas of the premises.

366 - That a challenge 25 scheme shall be maintained at the premises requiring that staff selling alcohol request that any customer who looks under 25 years old, and who is attempting to purchase alcohol, provides valid photographic identification proving that the customer is at least 18 years old. Valid photographic identification is composed of a driving licence, passport, UK armed services ID card, any Proof of Age Standards Scheme (PASS) accredited card or any identification card validated by the Secretary of State.

367 - That all staff involved in the sale of alcohol shall be trained in the prevention of sales of alcohol to underage persons (including the prevention of ‘proxy sales’), and the challenge 25 scheme in operation at the premises. A record of such training shall be kept / be accessible at the premises at all times and be made immediately available for inspection at the premises to council and / or police officers on request.

485 - (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises – (a) games or other activities which require or encourage, or are designed to require, encourage, individuals to - (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (whether within a time limit or otherwise); (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective; (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner carries a significant risk of undermining a licensing objective; (d) selling or supplying alcohol in association with promotional poster or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner; and (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

487 - The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

488 - (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either (a) a holographic mark; or (b) an ultraviolet feature.

489 - The responsible person shall ensure that - (a) Where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures - (i) Beer or cider: 1/2 pint; (ii) Gin, rum, vodka or whisky: 25 ml or 35 ml; and (iii) Still wine in a glass: 125 ml; (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available,

491 - 1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2. For the purpose of the condition set out in paragraph (1): (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b) "permitted price" is the price found by applying the formula P = D + (D x V), where- (i) P is the permitted price, (ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence – (i) the holder of the premises licence: (ii) the designated premises supervisor (if any) in respect of such a licence; or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (iv) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (v)"value added tax" means value added tax charged in accordance with the Value Added Tax Act 1994. 3. Where the permitted price given by paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4. (1) Sub-paragraph (2) applies where the permitted price given by paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax; (2) the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
