Conditions: 100 - No supply of alcohol may be made under the Premises Licence - (a). At a time when there is no Designated Premises Supervisor in respect of the Premises Licence; or (b). At a time when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended.

101 - Every supply of alcohol under the Premises Licence must be made, or authorised by, a person who holds a Personal Licence.

340 - That the premises will function as an alcohol order packaging site only. There will be no access to the premises by the general public under any circumstances.

341 - That all internet sales of alcohol will be age-verified at point of purchase within the company's mobile application.

342 - On receipt of an alcohol order a company director and/or employee of HungryPanda Ltd will package the order at the premises for delivery. Any persons employed/engaged in the procurement of alcoholic products for delivery will be a director and/or employee of HungryPanda Ltd (the premises licence holder) and will have received training in relation to the Licensing Act 2003 prior to alcoholic products being sold.

343 - All deliveries will be conducted by a director and/or employee of HungryPanda Ltd. Orders will be signed for at point of delivery, and photographic identification proving age taken for any order recipients appearing to be under the age of 25. Any director or employee of the company will have received training under the Licensing Act 2003 prior to undertaking deliveries.

344 - Training under the Licensing Act 2003 required for alcohol order procurement and/or delivery will be carried out for any director or employee of HungryPanda Ltd prior to commencement of licensable activities and refreshed on a 6 monthly basis. This training will be documented and recorded on staff files.

345 - That a Supervisor's Register will be maintained at the licensed premises, showing the names, addresses and up-to-date contact details for the Designated Premises Supervisor and all personal licence holders. The register will state the name of the person who is in overall charge of the premises at each time that licensed activities are carried out. This information will be retained for a period of twelve months and produced for inspection on request to an authorised officer.

346 - That a Fire and Emergency Planning Risk Assessment will be carried out.

347 - CCTV • A Closed-Circuit Television (CCTV) camera system is installed and will be maintained in working order as per the minimum requirements of a Metropolitan Police Crime Prevention Officer. All entry and exit points will be covered. • The locations of CCTV cameras are identified on the site plan of the premises. No changes to the locations of the cameras will be made without prior consultation with the Metropolitan Police and the Licensing Authority. • The CCTV will be in operation when the premises is open to the public. CCTV recordings shall be of a satisfactory quality enabling the identification of persons and activities, and other fine details. CCTV recordings shall be retained for a minimum period of 31 days with date and time stamping. • The CCTV system will be capable of securing relevant pictures for review at a later date, and/or export via removable media. Records will be made immediately available on request by the Police or an authorised council officer. Exported files shall be re-playable immediately without requirement for re-indexing of files or verification checks. • The CCTV footage will be controlled and kept in a secure environment to prevent tampering or unauthorised viewing. A record will be kept of who has accessed the system, the reason why and when. • A designated member/members of staff at the premises will be authorised to access the CCTV footage and be conversant with operating the CCTV system. At the request of an authorised officer of the Licensing Authority or a Responsible Authority (under the Licensing Act 2003) any CCTV footage, as requested, will be downloaded immediately or secured to prevent any overwriting. The CCTV footage material will be supplied, on request, to an authorised officer of the Licensing Authority or a Responsible Authority. • The CCTV system will be adequately maintained. If the CCTV becomes inoperative, the Police and Local Authority will be informed as soon as practically possible and immediate steps will be taken to put the equipment back into action.

348 - Proof of age • A proof of age policy to the satisfaction of the Metropolitan Police and the Licensing Authority will be in place. Alcohol sales will take place via internet. There will be no public access to the licensed premises. Alcohol orders will not be accepted in person at the premises, nor will orders be available for collection. • All sales and deliveries will be subject to licence conditions and proof of age checks under the "Challenge 25" policy developed by the Retail of Alcohol Standards Group.

349 - Alcohol Packaging and Preparation: • Any persons employed/engaged in the procurement of alcoholic products for delivery will be an employee of the premises licence holder and will have received training in relation to the Licensing Act 2003. This training to have taken place prior to alcoholic products being sold. • The placing of orders by customers via mobile application, and the packaging and preparation of those orders, will take place only between the hours of 08:00 and 20:00 as per the operating schedule.

350 - Alcohol Delivery: • Any director or employee of the premise licence holder company HungryPanda Ltd will have received training under the Licensing Act 2003, prior to undertaking deliveries of alcoholic products. This training will be documented and recorded on staff files, and refreshed every 6 months. • All deliveries of alcoholic products conducted by the premise licence holder/or employee will be signed for at point of delivery, and photographic identification proving age taken for any order recipients appearing to be under the age of 25. • The delivery of orders will take place only between the hours of 08:00 and 20:00 as per the operating schedule.

351 - That directors and/or employees of HungryPanda Ltd shall receive induction training under the Licensing Act 2003, including underage alcohol sales training, at the commencement of employment. Staff shall receive regular re-training a minimum of twice a year. Staff training records shall be maintained for inspection by the Metropolitan Police and Local Authority Enforcement Officers.

352 - The Premises Licence Holder/Designated Premises Supervisor will ensure that an Incident Report Register is maintained on the premises to record incidents such as sales refusals. The Incident Report Register will contain consecutively numbered pages, the date time and location of the incident, details of the nature of the incident, the names and personal licence numbers (if any) of any other staff involved or to whom the incident was reported, the names and numbers of any police officers attending, the police incident and/or crime number, names and addresses of any witnesses and confirmation of whether there is CCTV footage of the incident.

353 - There will be no general public access to the licensed premises.

354 - Fire safety: • Smoke detectors, fire extinguishers and related equipment shall be installed and inspected at appropriate intervals to ensure that they are in good working order. • Access routes to fire escapes will be kept unobstructed. • Exits will be easily identifiable and will be kept unobstructed and free of trip hazards with non-slippery, even surfaces. • Any/all emergency doors shall be maintained effectively, self- closing and not held open other than by an approved device.

355 - Electrical Installations: • Electrical installations, including any temporary electrical wiring and distributions, will be inspected on a periodic basis (at least every 3 years or at a frequency specified in writing) by a suitably qualified and competent person. • Inspection records/certificates will be kept and made available at the request of an authorised officer.

356 - That an adequate and appropriate supply of first aid equipment and materials will be available on the premises.

357 - The use of moped/motorcycle delivery vehicles represents a potential noise nuisance for residents of Glengall Road – particularly within the part of the Glengall Road Conservation Area that connects the Glengall Business Centre to the Old Kent Road (A2). With that in mind, the applicant HungyPanda Ltd will route delivery drivers via the rear entrance to the business centre on Ossory Road. This enables drivers to join the Old Kent Road without passing through a residential area.

358 - All sales and deliveries will be subject to licence conditions and proof of age checks under the "Challenge 25" policy developed by the Retail of Alcohol Standards Group.

359 - Electronic payments for alcohol will be accepted via the applicant HungyPanda Ltd’s mobile application which includes age verification checks. Purchases will not be allowed to complete without successful age verification. Invoice records will be kept of the client name, date of birth, address, contact telephone number, payment method used for each completed order, the items ordered and the total cost of the items. The invoices are to be kept at the premises and, subject to Data Protection Legislation, will be made available for inspection at the request of the Metropolitan Police or an authorised officer of the Local Authority.

360 - All deliveries of alcohol will be made to bona fide addresses without exception. Following revised Guidance issued under section 182 of the Licensing Act 2003, published April 2017, age-verification will be carried out at the point of delivery. • All deliveries of alcoholic products conducted by the premise licence holder/or employee will be signed for at point of delivery, and photographic identification proving age taken for any order recipients appearing to be under the age of 25. Acceptable forms of identification will be those bearing the order recipient’s photograph, date of birth and either a holographic mark, or an ultraviolet feature. Examples of accepted forms of identification include a proof of age card bearing the PASS hologram logo, an EU photo card, full driving licence or a passport. A permanent record will be kept of all signatures provided by customers at point of delivery. This record will, subject to Data Protection Legislation, be made available for inspection at the request of the Metropolitan Police or an authorised officer of the Local Authority. • For alcoholic products delivered by the premise licence holder HungyPanda Ltd, or employee of, that employee will have received training under the Licensing Act 2003, prior to undertaking deliveries. This training will be documented and recorded on staff files, and refreshed every 6 months.

361 - The date, time and circumstances under which any attempted purchase or delivery has been refused will be recorded in the Refusals Register. With respect to sales via mobile application the register will specifically record sales refused due to the failure of a completed age-verification procedure to confirm that the customer is eligible to purchase alcohol. Customers who discontinue their purchase without completing the age-verification procedure will not be recorded. • With respect to the delivery of orders by HungyPanda Ltd, a record will be kept of refusals to order recipients who are unable to verify their age with acceptable identification on request. • The Refusals Register will, subject to Data Protection Legislation, be made available for inspection at the request of the Metropolitan Police or an authorised officer of the Local Authority.

488 - (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either (a) a holographic mark; or (b) an ultraviolet feature.

491 - 1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2. For the purpose of the condition set out in paragraph (1): (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b) "permitted price" is the price found by applying the formula P = D + (D x V), where- (i) P is the permitted price, (ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence – (i) the holder of the premises licence: (ii) the designated premises supervisor (if any) in respect of such a licence; or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (iv) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (v)"value added tax" means value added tax charged in accordance with the Value Added Tax Act 1994. 3. Where the permitted price given by paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4. (1) Sub-paragraph (2) applies where the permitted price given by paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax; (2) the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
